You are acquiring a used, fully exhausted volume licence for Microsoft Windows 11 Education for permanent use on one device. The licence was originally acquired lawfully by an educational institution or a commercial first purchaser under a Microsoft Volume Licensing Agreement.
The conditions for exhaustion under § 69c No. 3 sentence 2 UrhG in conjunction with Art. 4(2) of Directive 2009/24/EC are met:
- The first sale took place within the EU with the consent of the rights holder (Microsoft).
- The previous owner rendered the program copy unusable on their systems (uninstallation and deactivation).
- The licence chain is fully documented and can be disclosed on request (CJEU, judgment of 03.07.2012, C-128/11 “UsedSoft/Oracle”; BGH, judgment of 17.07.2013, I ZR 129/08 “UsedSoft II”).
The product key is an inseparable part of this licence and can be activated once on one device. Simultaneous use on multiple devices is excluded.
